SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS


We are offering an SMS/MMS mobile messaging program (the 'Program'), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the 'Agreement'). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the 'Dispute Resolution' section below. The Program uses artificial intelligence ('AI') technology to generate personalized messages, product recommendations, and conversational responses. Some or all messages you receive through the Program may be composed, in whole or in part, by AI systems rather than human agents.


AI-Powered Messaging Messages you receive through the Program may be generated using artificial intelligence and machine learning technology. This means that some messages, including product recommendations, promotional offers, and conversational responses, are created by AI systems rather than written by a human. You acknowledge and agree that:

(a) AI-generated messages may contain inaccuracies. While we strive to provide helpful and accurate information, AI-generated messages may include errors regarding product details, pricing, availability, promotions, or other information. You should independently verify any product information, pricing, or promotional offers before making a purchase decision.
(b) AI responses are not professional advice. AI-generated messages do not constitute professional, legal, medical, financial, or other expert advice.
(c) Your conversations may be processed by AI. When you reply to messages or engage in conversations through the Program, your responses may be processed by AI systems to generate relevant replies. Your message content, purchase history, and browsing activity may be used by AI systems to personalize your experience.
(d) You may request human assistance. If at any time you prefer to interact with a human representative rather than an AI system, you may request human assistance by contacting us.

By participating in the Program, you agree to receive recurring automated marketing mobile messages, including AI-generated content, personalized product recommendations, and conversational AI responses, at the phone number associated with your opt-in. You understand that consent is not required to make any purchase from Us. While you consent to receive messages sent using an autodialer and/or AI-generated content, the foregoing shall not be interpreted to suggest or imply that any or all of Our mobile messages are sent using an automatic telephone dialing system ('ATDS' or 'autodialer'). You specifically consent to receiving messages where the content is generated, in whole or in part, by artificial intelligence systems.

Data Use for AI Personalization To provide you with personalized messages and recommendations through the Program, we may use information including your purchase history, browsing activity, product preferences, and prior message interactions. This information may be processed by AI systems, including third-party AI service providers, to generate relevant and personalized communications. We do not sell your personal information to third parties. Our AI service providers are contractually prohibited from using your personal information to train their general-purpose AI models.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO: (A) INACCURACIES, ERRORS, OR OMISSIONS IN AI-GENERATED MESSAGES, INCLUDING INCORRECT PRODUCT INFORMATION, PRICING, OR AVAILABILITY; (B) ANY DECISION YOU MAKE BASED ON AI-GENERATED CONTENT; (C) ANY PRODUCT RECOMMENDATION GENERATED BY AI SYSTEMS; OR (D) THE PERFORMANCE, RELIABILITY, OR AVAILABILITY OF AI FEATURES. THE PROGRAM AND ALL AI-GENERATED CONTENT ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND.

These Terms of Service ("Terms") govern your use of the Amora website, your purchase of our products, and your participation in our services, including our mobile messaging programme. By accessing our website, placing an order, or opting in to any of our services, you agree to these Terms. Please read them carefully.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 and other applicable UK law. Where any term conflicts with your non-excludable statutory rights, your statutory rights prevail.

1. About Us

Amora ("we", "us", "our") is a brand operated by FOLAIR BRANDS LTD, a company registered in England & Wales. You can contact us at support@amorakeepsakes.com.

2. Eligibility & Account

By placing an order you confirm that you are at least 18 years old and legally able to enter into a binding contract. You are responsible for keeping any account credentials secure and for all activity under your account.

3. Orders & Contract Formation

Your order is an offer to buy. A binding contract is formed only when we send you an order confirmation or dispatch confirmation. We reserve the right to decline or cancel any order before dispatch — for example, where an item is out of stock, where there has been a pricing or description error, or where we suspect fraud — and to refund any payment taken in such cases.

4. Pricing & Payment

  • All prices are shown in GBP and include VAT where applicable.
  • We take reasonable care to ensure prices are correct, but errors can occur. Where the correct price is higher than the price shown, we will contact you before dispatch and you may cancel the order.
  • Payment is taken at the time of order through our payment providers. We do not store full card details.

5. Products & Descriptions

We take care to describe and show our products accurately. Minor variations in colour, finish, or measurement may occur due to photography, screen settings, and the handmade or natural characteristics of materials. Such reasonable variations do not constitute a defect.

Where a product description specifies a material or property (for example, the material composition of a piece), that description forms part of the contract. Any claims made about durability or finish apply to the specific product as described and to normal use in accordance with our care guidance.

6. Your Statutory Rights

As a consumer, you have legal rights under the Consumer Rights Act 2015. In summary, the products we supply must be of satisfactory quality, fit for purpose, and as described. If a product is faulty, not as described, or unfit for purpose, you may be entitled to a repair, replacement, or refund depending on the circumstances and timing of the issue. These rights are in addition to, and not replaced by, our Lifetime Guarantee below.

Your rights in relation to cancellation, change-of-mind returns, and refunds are set out in our separate Returns Policy, available at https://www.amorakeepsakes.com/policies/refund-policy, which forms part of these Terms.

7. Amora Lifetime Guarantee

Our Lifetime Guarantee is a voluntary commercial guarantee that we offer in addition to your statutory rights. It does not limit or replace those rights. It is designed to protect against genuine manufacturing defects, while setting clear expectations on what is and is not covered.

7.1 What the Guarantee Covers

The Guarantee applies to manufacturing defects in materials or workmanship that were present at the time of purchase, such as structural faults, defective clasps or settings, and material flaws not caused by external factors.

7.2 Meaning of "Lifetime"

"Lifetime" refers to the reasonable functional lifespan of the product, not the lifetime of the purchaser. This does not affect the time limits within which you may bring a claim under your statutory rights.

7.3 Eligibility

To submit a Guarantee claim you must be the original purchaser, provide valid proof of purchase, submit the claim through our official support channels, provide clear photographic evidence, and return the item for inspection if reasonably requested.

7.4 Resolution (If Approved)

Where a claim is approved under the Guarantee, we will resolve it by repairing the item, replacing it with the same or a comparable product, or issuing store credit equal to the original purchase price. The resolution method offered under this voluntary Guarantee is at our discretion. This does not affect any right you may have to a refund under your statutory rights where those rights apply.

7.5 What the Guarantee Does Not Cover

The Guarantee does not cover normal wear and tear; scratches, dents, or surface damage; damage caused by impact, force, or external stress; improper storage or handling; misuse or failure to follow care instructions; third-party modifications or repairs; or lost or stolen items. Cosmetic changes arising from normal use are not, by themselves, treated as manufacturing defects under this voluntary Guarantee.

This exclusion applies to the voluntary Guarantee only. If a fault would amount to a breach of your statutory rights (for example, an item that is not of satisfactory quality), those rights still apply regardless of this section.

7.6 Care Requirements

To remain eligible under the Guarantee, products should be cared for in line with our care guidance. Claims may be declined under the Guarantee where damage is shown, on reasonable assessment, to have been caused by failure to follow that guidance.

7.7 Inspection & Assessment

Guarantee claims are subject to reasonable review to assess whether a qualifying defect exists. We will carry out this assessment fairly and reasonably. Nothing in this section prevents you from exercising your statutory rights or pursuing independent remedies if you disagree with our assessment.

7.8 Limitations

  • One approved Guarantee claim per item.
  • Replacement items are covered for the remainder of the original Guarantee, and carry your statutory rights afresh as applicable by law.
  • The Guarantee is non-transferable and applies to the original purchaser.

7.9 Discontinued Items

If an item is no longer available, we may offer a comparable replacement or store credit. We are not obliged to provide an identical item under the voluntary Guarantee.

7.10 Guarantee Shipping

For voluntary Guarantee claims, you are responsible for return shipping costs unless the item is found to be faulty, in which case we will reimburse reasonable return postage as required by law. Where return is required to assess a suspected fault under your statutory rights, we will cover reasonable return costs in line with those rights.

8. Mobile Messaging Programme (SMS/MMS)

We offer an SMS/MMS mobile messaging programme (the "Programme"). By opting in, you agree to these Terms and our Privacy Policy.

The Programme uses artificial intelligence ("AI") to generate personalised messages, recommendations, and conversational responses. Some or all messages you receive may be composed, in whole or in part, by AI rather than a human.

  • AI-generated messages may contain inaccuracies regarding product details, pricing, availability, or promotions. Please verify any such information before purchase.
  • AI-generated messages do not constitute professional, legal, medical, or financial advice.

9. Acceptable Use

You agree not to misuse our website or services, including by attempting to gain unauthorised access, interfering with their operation, or using them for unlawful purposes. We may suspend or withdraw access where we reasonably believe these Terms have been breached.

10. Intellectual Property

All content on our website — including text, images, logos, designs, and the Amora name and branding — is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, or use it without our prior written permission, except as necessary to view the site and use our services normally.

11. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for any breach of your non-excludable statutory rights.

Subject to the above, and to the fullest extent permitted by law: we are not liable for indirect, consequential, or unforeseeable loss; we are not liable for loss arising from your failure to follow our care guidance or product instructions; and our total liability to you in connection with any product or order shall not exceed the price you paid for it, except where a higher remedy is required by your statutory rights.

To the maximum extent permitted by law, AI-generated content within the Programme is provided "as is" and "as available", and we are not liable for inaccuracies in, or decisions you make based on, AI-generated messages — save that this does not affect your statutory rights in respect of the products you purchase.

12. Events Outside Our Control

We are not liable for delay or failure to perform caused by events outside our reasonable control, including supplier failure, courier delay, or disruption to communications or systems. Where such an event occurs, we will take reasonable steps to minimise its effect.

13. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place an order or opt in to a service applies to that transaction. We will post the current version on our website with the "last updated" date shown above.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. Disputes will be subject to the non-exclusive jurisdiction of the courts of England & Wales. If you live in another part of the UK, you may also bring proceedings in your local courts. Nothing in this section removes any statutory protection available to you as a consumer.
